Effective Date: Upon clicking "I Agree" or accessing the Service.
These Terms of Use ("Terms") govern the access and use of the Tylogram platform, provided by Tylogram Solutions (pending incorporation/legal entity), headquartered in Germany ("Company", "we", "us").
By creating an account, selecting a Subscription Plan (Free, Draft, Pro, or Ultra), or uploading any Piping and Instrumentation Diagram (P&ID), you ("User", "Customer") agree to be bound by these Terms.
Tylogram utilizes advanced Artificial Intelligence (Google Vertex AI) to analyze engineering diagrams. You acknowledge that: (a) The Service is a decision-support tool only; (b) The Output provided by Tylogram (including symbol detection, logic verification, and HAZOP suggestions) is based on probabilistic models and may contain errors, omissions, or "hallucinations"; (c) The Service does NOT replace the professional judgment of a certified engineer, safety manager, or HAZOP chairman.
WE EXPRESSLY DISCLAIM ANY LIABILITY FOR INDUSTRIAL ACCIDENTS, PROCESS FAILURES, OR NON-COMPLIANCE FINES. YOU REMAIN SOLELY RESPONSIBLE FOR THE FINAL VERIFICATION OF ALL DRAWINGS AND SAFETY SYSTEMS.
Your access is strictly limited by the Tier you select. Violating these limits constitutes a material breach of this Agreement.
Accounts are individual (Named User). Sharing credentials to bypass the "1 page/week" limit of the Free Tier or the quotas of paid tiers will result in immediate account suspension.
You retain all ownership rights to the P&IDs, diagrams, and documents you upload ("User Content"). You grant Tylogram a limited, non-exclusive license to process this content solely for the purpose of providing the analysis.
(a) No Public Training: We guarantee that your Sensitive Industrial Data (P&IDs) is NOT used to train our public AI models or shared with third parties for model improvement, in accordance with our Enterprise Agreement with Google Cloud.
(b) Processing Location: Data is processed in secure cloud environments (Google Cloud Platform), adhering to strict enterprise security standards.
You own the reports, lists (BOM), and annotations generated by the Service.
We treat your P&IDs as Strictly Confidential. We employ industry-standard encryption (AES-256) in transit and at rest. However, you acknowledge that no transmission over the internet is 100% secure. You agree not to upload data classified as "Top Secret" by government entities or data that violates third-party NDAs without proper authorization.
To the fullest extent permitted by applicable law (including German Civil Code - BGB): (a) Tylogram shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business interruption. (b) Our total liability for any claim arising out of these terms shall not exceed the amount you paid to us in the 12 months preceding the claim (or €100 if you are on the Free Tier).
Nothing in these Terms excludes liability for damages caused by intent or gross negligence (Vorsatz oder grobe Fahrlässigkeit) or for death/personal injury caused by our negligence.
Paid subscriptions renew automatically on a monthly basis unless cancelled at least 24 hours before the renewal date.
We may terminate your access immediately if you attempt to reverse-engineer the AI, scrape our database, or violate the Usage Limits.
These Terms shall be governed by the laws of the Federal Republic of Germany. The exclusive jurisdiction for all disputes shall be the courts of Munich, Germany.
